Senado aprobó en general retiro del 10% de los fondos de las AFP

En el marco de la emergencia sanitaria por el Covid-19, la noche de este miércoles 22 de julio la Sala del Senado aprobó en general la reforma constitucional que busca permitir el retiro del 10% de las AFP de parte de los cotizantes, con 29 votos a favor, 13 en contra y una abstención, por lo que ahora la iniciativa volvió a la Cámara de Diputados para su tercer y último trámite legislativo.
Durante la discusión en la Comisión de Constitución del Senado fueron aprobadas 8 indicaciones, entre ellas están que los pensionados puedan acceder también al retiro de fondos, la creación de un fondo solidario (que en la Cámara de Diputados fue rechazado) y que quienes accedan a este beneficio podrán hacerlo durante el plazo de un año desde que promulgue la ley, entre otros.
El presidente de la Cámara de Diputados, Diego Paulsen (RN), anunció que este mismo jueves se discutirán las modificaciones introducidas por el Senado en una sesión especial citada a partir de las 10.00 AM. De ser ratificadas por la Cámara Alta, el proyecto será despachado y quedará listo para su promulgación.
Luego de discutir el quórum que era necesario para la aprobación del proyecto de reforma constitucional, las y los senadores comenzaron a entregar sus alegatos a favor o en contra de este.
Manuel José Ossandón (RN) dijo que votaría a favor, señalando que lo hacía “por los que no tienen voto. Basta de apuntar con el dedo y tratar de ‘traidores’ a quienes hemos sido inconsecuentes”, agregó.
Por su parte, Andrés Allamand (RN) señaló que votaría en contra del retiro del 10% de las AFP y expuso que “hay algunos que les importan mucho más las encuestas del día lunes que la consecuencia con sus pensamientos”. En tanto, José Miguel Insulza (PS) justificó su voto favorable señalando el Gobierno debe tomar “medidas focalizadas, se requieren medidas de cobertura lo más universal posible”.
Carlos Bianchi (Independiente) e Isabel Allende (PS) anunciaron su voto favorable, instando al Gobierno a mejorar las medidas dirigidas a la clase media. Luz Ebensperger (UDI), adelantó su rechazo señalando que no están defendiendo a las AFP, sino “un sistema de ahorro individual con componentes solidarios”.
Ricardo Lagos Weber (PPD), en tanto, entregó su voto a favor respaldándose en la “falta de ayuda del Gobierno”, y Francisco Chahuán (RN) también se mostró a favor, insistiendo en que el Ejecutivo debe apurar los paquetes de ayuda”.
De esta manera, existirían dos escenarios disponibles en el camino del Ejecutivo. Primero vetar el proyecto, esto si ambas cámaras superan los 2/3 de la votación, lo que sumaría una nueva derrota para La Moneda. Mientras que la segunda opción sería llevarlo al Tribunal Constitucional, lo cual, dependiendo si la votación también fuera de 2/3, podría ser superado.
